Prize Draws And Competitions

  1. Unless otherwise stated, our competitions and prize draws are organised by Jamie Oliver Enterprises Limited (registered number 06294067) whose address is 19-21 Nile Street, London N1 7LL.
  2. By entering into one of our competitions or prize draws, you agree and accept the terms and conditions of the relevant competition or prize draw as well as these general terms and conditions.
  3. Only one entry per person is permitted for each competition or prize draw unless otherwise stated in the terms and conditions of the relevant competition or prize draw.
  4. Our competitions and prize draws are open to all residents in Australia over the age of 18, unless stated otherwise in the terms and conditions of the relevant competition or prize draw, but is closed to any employees (and members of their families and households) of Jamie Oliver Enterprises Limited, its associated companies and of any co-promoters, competition or prize draw sponsors, prize providers and any of their associated companies.
  5. Competition and prize draw entries must be made in the manner specified in the terms and conditions of the relevant competition or prize draw and must be received by the closing date stated therein
  6. No purchase or fee is payable in order to enter a competition or prize draw. Where applicable details of free entry routes will be available in the relevant competition or prize draw's terms and conditions.
  7. By entering into a competition or prize draw, you agree that your name and general place of residence may be made public if you win and if the relevant competition or prize draw includes submitting any images, photographs or footage that these may be used for any purpose by Jamie Oliver Enterprises Limited and/or its associated companies and/or any co-promoters, competition or prize draw sponsors, prize providers and any of their associated companies.
  8. No responsibility will be accepted for entries which we do not receive for any reason. Incomplete or late entries will be disqualified.
  9. Jamie Oliver Enterprises Limited its associated companies and any co-promoters, competition or prize draw sponsors, prize providers and any of their associated companies will not be responsible for the non-inclusion of entries as a result of technical failures or otherwise, including any such failure which is within the control of Jamie Oliver Enterprises Limited its associated companies and any co-promoters, competition or prize draw sponsors, prize providers and any of their associated companies. Proof of submission of entry is not proof of receipt of entry.
  10. Jamie Oliver Enterprises Limited reserves the right at its sole discretion to disqualify any person it finds to be tampering or to have tampered with the operation of the promotion, the Jamie Oliver Limited website or any other website or platform (including without limitation digital and social networking platforms) on which Jamie Oliver Enterprises Limited is organising a prize draw or competition, or to be acting in violation of these terms and conditions
  11. Details of how entrants may compete or be chosen to win can be found in the terms and conditions of the relevant competition or prize draw
  12. The prize must be taken as offered. No cash equivalent or other alternative prizes are available.
  13. The prize is non-transferable. We or the relevant prize provider as applicable reserve the right to substitute the prize of an equivalent value should the prize or any part of the prize become unavailable for any reason
  14. If the winner cannot be contacted or is not able to accept the prize within 2 months of the relevant competition or prize draw's closing date, then we reserve the right to award the prize to another participant.
  15. We reserve the right to amend these rules at any time, or to cancel, alter or amend the competition or prize draw at any stage should it be necessary.
  16. By entering into a competition or prize draw, you agree that any personal information you supply may be used by Us in accordance with our Privacy and Data Protection Policy as at the date of your entry as found at www.jamieoliver.com/privacy.
  17. We accept no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering a competition or prize draw or by accepting (or refusing as the case may be) a prize
  18. The competition or prize draw is subject to the laws of England and Wales, whose courts shall be the courts of exclusive jurisdiction

These terms and conditions apply solely to the Website insofar as it covers Jamie’s Italian restaurants in Australia and do not apply more broadly to the content on the Jamie’s Italian website in the United Kingdom. The Website is owned by Jamie Oliver Enterprises Limited, a limited liability company registered in England and Wales (company number 06294067) with its registered office at 19/21 Nile Street, London N1 7LL, UNITED KINGDOM (Jamie Oliver Enterprises Limited). The Website is operated in Australia under licence by The Keystone Group Pty Ltd (ABN 81150462025 at PO Box 506, Potts Point NSW 1335 AUSTRALIA) (referred to as “Keystone”, “we”, “us” or “our”). By using this Website, you agree to be bound by these terms and conditions. If you do not accept these terms and conditions, you should cease using the Website.

We reserve the right to alter these terms and conditions from time to time. The amendments will take effect immediately upon publication on the Website and it is your responsibility to check this page periodically for changes. Your continued use of the Website after the publication of such amendments will constitute an agreement by you to be bound by the amended terms and conditions.

Some parts of this Website may have specific terms of use (for example, our Australian gift cards facility). Your registration for and/or use of these parts of the Website constitutes agreement to these specific terms and conditions. If there is any conflict between these terms and conditions and the specific terms of use appearing on other parts of this Website, the specific terms of use for the relevant other part of the Website shall prevail.

2. Restricted Use

Unless we provide you with or written consent to the contrary, you are provided with access to the Website for your personal use only. You are authorised to print a copy of any information contained on the Website for your personal, non-commercial use, unless such printing is expressly prohibited. You may not on-sell information obtained from the Website.

3. Online Booking Service

  1. Making an online booking

    The Website contains online booking facilities for Jamie’s Italian restaurants in Australia. To make an online booking for a Jamie’s Italian restaurant in Australia (online booking), you must complete all relevant fields in the online booking flow, including your name, mobile number, email address and any special requests required before booking.

    After submitting the online booking request, you will receive an email to confirm your reservation.

    You will not be charged a booking fee for making an online booking request. You simply pay us for your meal after you have dined in the restaurant.

  2. Changing an online booking

    To make a change or changes to the date, time or number of diners in an online booking, you must contact the Jamie’s Italian restaurant at which you have booked directly at least 2 hours in advance of your original booking time.

    Any changes are made at the absolute discretion of the Jamie’s Italian restaurant at which you have booked and are subject to availability.

  3. Cancelling a booking

    To cancel a booking at a Jamie’s Italian restaurant, you must contact the Jamie’s Italian restaurant at which you have booked directly at least 24 hours in advance.

4. Conduct At Jamie’s Italian Restaurants

  1. Arrival at restaurant

    All guests must be present before we are able to seat your table. We recommend arriving 10 minutes before your reservation time.

  2. Meal duration

    All tables booked using our online booking service will be available for 2.5 hours only.

  3. No shows

    Failure to attend the Jamie’s Italian restaurant at which you have booked at the scheduled time for your booking, or failure to attend at all may result in you being identified as a ‘no-show’. The restaurant reserves the right to cancel your booking and allocate your table to other guests if you have not arrived within 15 minutes of the scheduled time for your booking.

5. Copyright

Copyright in the Website (including all text, graphics, logos, icons and software), recipes, photographs, menu design, marketing materials and all other documents supplied by us is owned by Jamie Oliver Enterprises Limited and licensed to Keystone.

Except as permitted by the Copyright Act 1968 (Cth) or other applicable laws, or as authorised by these terms and conditions, you may not:

  1. adapt, reproduce, store, distribute, print, display, reverse-engineer, perform, publish or create derivative works from any part of the Website, recipes, photographs or any other materials; or
  2. commercialise any information, products or services obtained from any part of the Website, recipes, photographs or any other materials,

without our written permission.

You may not place a link from any other website to the Website without our prior written consent.

We do, however, grant you a limited, non-transferable licence to access and use the Website in accordance with these terms and conditions solely for your personal, non-commercial purposes. Except as provided in these terms and conditions, or as permitted by relevant copyright legislation, permission to use or copy the Website or any of the contents of the Website for any other purpose is expressly prohibited. Subject to applicable law, we may revoke the permission referred to in this paragraph at any time, or may suspend or deny, in our sole discretion, your access to, or use of, the Website without notice.

Jamie Oliver Enterprises Limited owns a number of registered trade marks in Australia, including Trade Mark Nos. 1202381 (JAMIE’S ITALIAN) and 989401 (JAMIE OLIVER). All other trade marks and logos that appear on the Website are either owned or licensed by Jamie Oliver Enterprises Limited and licensed to Keystone.

You must not use any of the trade marks owned or licensed by Jamie Oliver Enterprises Limited:

  1. in, or as the whole or part of, your own trade marks;
  2. in connection with activities, products or services which are not ours;
  3. in a manner which may be confusing, misleading or deceptive; or
  4. in a manner that disparages us or our information, products or services (including the Website).

In addition, the Website and the technology and processes contained on it may also be the subject of other intellectual property rights owned by us or third parties. No licence is granted to you in respect of any of the intellectual property rights referred to in this paragraph other than as specifically set out in these terms and conditions.

The Website contains links to third party websites, and also advertisements that include embedded links. Links to third party websites are provided for your information and convenience only. We have not reviewed any of the sites linked to the Website and are not responsible for the content or accuracy of any material on any third party website. The inclusion of any link or advertisement does not imply that we endorse the linked third party website or the subject matter of the advertisement and you follow any such link at your own risk.

We accept no responsibility for any loss or damage, whether direct or indirect and however caused (including through negligence) that you may suffer in connection with your use of the Website or any linked website. You must ensure that your use of the Website is not illegal or prohibited by laws which apply to you. We reserve the right to screen, filter and/or monitor content for this purpose.

We do not warrant or represent that the Website or emails received from us pursuant to the mailing list facility or “Talk to Us” facility will be uninterrupted or error free or free of other harmful components. You must take your own precautions to ensure that your access to the Website does not expose you to the risk of any viruses, malicious computer codes or other forms of interference that may damage your computer system. We do not accept any responsibility for any interference or damage to your computer system which arises in connection with your use of the Website or any linked website, or your receipt of emails from us pursuant to the mailing list facility or “Talk to Us” facility.

10. Indemnification

You agree to indemnify, defend and hold harmless Jamie Oliver Enterprises Limited, Keystone and any parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, suppliers and employees of Keystone from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these terms and conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

11. Security Of Information

You acknowledge that the security of any data transmitted via the internet cannot be guaranteed. We will use our best efforts to protect any information you transmit to us via the Website. However, we do not warrant or guarantee the security of such information. If you transmit information to us via the Website, you do so at your own risk.

12.interruption Or Termination Of Access

Access to the Website may be interrupted or terminated at any time, for any reason whatsoever. These terms and conditions survive interruption or termination of access to the Website.

13. Privacy

By using the Website, you grant us and Jamie Oliver Enterprises Limited consent to collect, store, use and disclose any personal information you may give us in accordance with our Privacy Policy. Please ensure that you have read and understood our Privacy Policy before accepting these terms and conditions.

By using the Website, you consent to us and Jamie Oliver Enterprises Limited collecting, storing, using and disclosing this type of information in accordance with these terms and conditions.

These terms and conditions, and your access to the Website, are governed by the laws of New South Wales, Australia, irrespective of where you have submitted a booking or where the restaurant you have booked is located. In any action or other legal process with respect to any matter or thing in connection with these terms and conditions, you submit to the non-exclusive jurisdiction of New South Wales, Australia.

Gift Cards Terms And Conditions

1. General

These terms and conditions apply to the purchase and provision of all gift cards, whether in physical or digital form, for use at Jamie’s Italian and Jamie’s Italian Trattoria restaurants in Australia (Gift Cards). Gift Cards are issued by [The Keystone Group Pty Ltd (ABN 81150462025 at PO Box 506, Potts Point NSW 1335 AUSTRALIA)] (referred to as “Keystone”, “we”, “us” or “our”). By placing an order for purchase of a Gift Card, you agree to be bound by these terms and conditions. If you do not accept these terms and conditions, you should not order a Gift Card.

We reserve the right to alter these terms and conditions from time to time. The amendments will take effect immediately upon publication on the Australian pages of the international website of Jamie’s Italian [(www.jamieoliver.com/italian/australia/home) (Website) and it is your responsibility to check this page periodically for changes. If you place an order for purchase of a Gift Card after the publication of such amendments, this will constitute an agreement by you to be bound by the amended terms and conditions.

These terms and conditions are to be read in conjunction with the Jamie’s Italian Australia Website Terms and Conditions. If there is any conflict between these Gift Card Terms and Conditions and the Website Terms and Conditions, these Gift Card Terms and Conditions will prevail.

2. Use Of Gift Cards

The following conditions apply to all Gift Cards:

  1. Gift Cards are not refundable or redeemable for cash and cannot be used to obtain a cash advance.
  2. Gift Cards are valid for 12 months from the date or purchase (subject to clause 4 below). Once the Gift Card has expired it cannot be reactivated and any unspent money will be forfeited.
  3. When a Gift Card is purchased, the purchaser is not required to use the entire available balance on the Gift Card in one transaction. However, if the available balance on the Gift Card is not entirely expended, we will not provide change or a refund. The remaining balance may be used in conjunction with future purchases until the Gift Card expires or the balance reaches nil.
  4. Gift Cards may only be used to make purchases up to the remaining value contained on the Gift Card. If you wish to make a purchase for an amount that exceeds the remaining value, you must pay the excess using another payment method.
  5. Gift Cards cannot be used to purchase additional Gift Cards.
  6. Gift Cards are not valid for use outside of Australia.

3. Physical Gift Cards

Gift Cards can be purchased in physical form (Physical Gift Cards) either by attending a Jamie’s Italian or Jamie’s Italian Trattoria restaurant in Australia or by using the online gift card store on the Website and specifying the ‘Physical Gift Card’ option. The commencement date for a Physical Gift Card will be the date on which we provide confirmation that the order has been submitted and payment has been accepted.

When a Physical Gift Card is purchased, the minimum value permitted is $20 and the maximum value permitted is $300. Physical Gift Cards may be topped up with additional credit at any time by using either of the order and payment methods specified in this clause.

Physical Gift Cards are only available for delivery within Australia. All orders will be delivered via Australia Post to a nominated residential or business address and will not be delivered to a PO Box or Locked Bag address. We will endeavour to deliver the Physical Gift Card within two (2) weeks from the date of purchase.

4. Digital Gift Cards

Gift Cards can be purchased in digital form (Digital Gift Cards) by using the online store on the Website and specifying the ‘Digital Gift Card’ option. The commencement date for a Digital Gift Card will be the date on which we provide confirmation that the order has been submitted and payment has been accepted.

When a Digital Gift Card is purchased, the minimum value permitted is $20 and the maximum amount is unlimited. Digital Gift Cards may be topped up with additional credit at any time by using the online payment method specified in this clause. Where a Digital Gift Card is topped up with additional credit, the Digital Gift Card will remain valid for 12 months from the date on which the additional credit was purchased.

Digital Gift Cards will be delivered to the email address nominated at the time of purchase. We will endeavour to electronically deliver the Digital Gift Card within twelve (12) hours from the time of purchase.

5. Credit Card Payments

Payment for Gift Cards (both Physical and Digital) may be made by cash, Visa, MasterCard, Diners Club or American Express.

For purchases made using the online gift card store on the Website, we will process your payment via a payment gateway, which will display the total amount paid for the Gift Card on a final screen prior to payment. This total amount may include delivery charges and any applicable credit card surcharge or service fee. By clicking ‘Pay Now’ you authorise us to debit the total amount from your nominated credit card.

We will not be required to fulfil any order where a nominated payment card is declined by a financial institution. If this occurs, you acknowledge that we may contact you (by using the contact details provided with your order) to make alternative payment and delivery arrangements.

6. Promotions And Discounts

Gift Cards may not be used in conjunction with any promotion, discount or offer made by us.

7. Cancellation Of Gift Cards

Once you have placed an order for a Gift Card and your payment has been accepted, we will not be able to cancel the order if requested by you.

In addition, we reserve the right to cancel any order for a Gift Card at any time, without notice, for any reason. This may include where we decline to accept payment from you by credit card for any reason. If we decline to accept payment, we will not process your order and may not contact you to inform you that your order will not be processed.

In the event of suspected or proven fraud and / or improper use of the Gift Card, we reserve the right to suspend, pending investigation, or cancel any Gift Card without notice.

We reserve the right to cancel the Gift Card scheme for any reason at any time and without notice. In these circumstances, any cards issued prior to the cancellation or revocation will be valid until their expiry date has elapsed or may be refunded at the sole and absolute discretion of Keystone.

8. Faulty Gift Cards

We will not re-issue a Gift Card that is claimed to be faulty or damaged unless the Gift Card is proven to be faulty or damaged as a result of the production process or otherwise due to the fault of Keystone, its agents or contractors.

9. Disclaimer

You are responsible for the use and safety of your Gift Card. You are liable for all transactions on your Gift Card, except to the extent to which there has been proven fraud or negligence by us or by any of our employees. We will not replace or refund lost or stolen Physical Gift Cards or Digital Gift Cards which have not been activated during the validity period.

We accept no responsibility for any loss or damage, whether direct or indirect and however caused (including through negligence) that you may suffer in connection with any Gift Cards that are on sold through any online auction sites. In addition, we are not liable for any losses suffered or incurred due to delay in delivery or for any lost or misdirected Gift Cards, including any Gift Cards lost or misdirected in the mail.

To the maximum extent permitted by law, we exclude any conditions or warranties that would otherwise be implied into these terms and conditions. Where a condition or warranty cannot by law be excluded, then that condition or warranty will be deemed included in these terms and conditions, but our liability in respect of any breach of that condition or warranty will be limited to the maximum extent permitted by law.

10. Queries Or Complaints

If you have reason to believe that an error has occurred in relation to your Gift Card, you should contact us at info@jamiesitalian.com.au.

If you wish to dispute an amount deducted from your Gift Card, you must contact our Head Office via email at info@jamiesitalian.com.au. If an amount is not disputed within two (2) weeks after the transaction date, we may refuse to provide you with a refund at its sole discretion.

Any complaints about services purchased with a Gift Card must be resolved directly with the Jamie’s Italian or Jamie’s Italian Trattoria restaurant in Australia concerned.

11. Governing Law

These Gift Card terms and conditions are governed by the laws of New South Wales, Australia, irrespective of where you have submitted a booking or where the restaurant you have booked is located. In any action or other legal process with respect to any matter or thing in connection with these terms and conditions, you submit to the non-exclusive jurisdiction of New South Wales, Australia.

Kids Eat Free

Offer available on the following dates: NSW 8 April- 24 April 2017, ACT 8 April- 25 April 2017, QLD 1 April- 17 April 2017, SA 14 April-30 April 2017 (excludes Anzac Day 25 April, as we are closed), WA 8 April- 23 April 2017 for lunch and dinner. Please note this offer also excludes Good Friday (14 April) in any state as our restaurants are closed on this day. There must be one adult dining per two free kids meals. The adult on the table must order a main size pasta or main in order to receive the Kids Eat Free Offer. This offer cannot be used in conjunction with any other offer. Available in all Jamie’s Italian Restaurants in Australia only.
